These Terms of Service govern your use of the CALIYI online store and purchases made from CALIYI.

By accessing the online store, submitting information or placing an order, you agree to these Terms of Service.

Online-store use

You must use the CALIYI online store only for lawful purposes.

You must not:

• Use the online store in breach of any applicable law.
• Submit false, misleading or fraudulent information.
• Use another person’s payment information without permission.
• Interfere with the security or operation of the online store.
• Attempt to gain unauthorised access to our systems.
• Introduce viruses, malware or harmful code.
• Scrape, copy or commercially exploit website content without permission.
• Use our products or services for unlawful purposes.

Eligibility to purchase

By placing an order, you confirm that:

• You are legally able to enter into the transaction.
• The information you provide is accurate and complete.
• You are authorised to use the selected payment method.
• You are purchasing for lawful personal or business purposes.

Where a customer is under 18, the purchase should be made or approved by a parent or legal guardian.

Product information

We take reasonable steps to display product descriptions, images, colours, features and specifications accurately.

The appearance of colours may vary depending on lighting, photography, screen settings and device settings.

Minor differences in product presentation or packaging may occur where they do not materially reduce the product’s quality or function.

Nothing in this section limits rights available under the Australian Consumer Law.

Orders

Submitting an order is an offer to purchase the selected products.

An order is not guaranteed to be accepted until payment has been authorised and the order has been confirmed.

We may decline or cancel an order where reasonably necessary, including where:

• A product is unavailable.
• Payment cannot be authorised.
• An obvious pricing or product-information error has occurred.
• Delivery is unavailable to the supplied address.
• We reasonably suspect fraud or unauthorised activity.
• The order breaches purchase limits.
• The order breaches these Terms of Service.

If we cancel an order after payment has been collected, we will refund the amount paid for the cancelled products.

Prices and payment

Prices are displayed in the currency shown through the online store or at checkout.

Applicable taxes, shipping fees and other charges will be displayed before the order is completed where reasonably possible.

You agree to provide accurate, complete and current billing and payment information.

Prices and promotions may change without notice. Changes will not ordinarily affect an order that has already been accepted, except where there is an obvious error.

Promotions and discount codes

Promotional offers may be subject to separate conditions.

Unless otherwise stated:

• Discount codes cannot be exchanged for cash.
• Discount codes cannot be applied retrospectively.
• Only one discount code may be used per order.
• Discount codes may not apply to shipping.
• Offers may be limited by date, customer, quantity or location.
• Products purchased using a promotion remain subject to our Return and Refund Policy.

We may cancel or modify a promotion where reasonably necessary because of an error, fraud, misuse or circumstances outside our control.

Shipping and delivery

Order-processing and estimated delivery information is set out in our Shipping Policy.

Delivery timeframes are estimates rather than guaranteed delivery dates.

Delivery may be affected by courier delays, customs processing, weather, public holidays, peak periods, incorrect delivery information or other circumstances outside our reasonable control.

Nothing in this section removes any remedy available under applicable consumer law.

International orders

International customers may be responsible for customs duties, import taxes, handling charges or other fees imposed by their country.

These charges are not controlled by CALIYI unless checkout specifically states that duties or taxes are included.

Customers are responsible for checking any local import restrictions before ordering.

Ownership and delivery risk

Ownership of the products passes to you after full payment has been received.

Responsibility for the product passes in accordance with applicable law when the product is delivered to the delivery address or collected by you.

Where a parcel is reported missing, damaged or stolen, we may require information and investigate the matter with the delivery provider before providing a resolution.

Returns and refunds

Returns, exchanges and refunds are handled in accordance with our Return and Refund Policy and applicable consumer law.

Nothing in these Terms of Service excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded.

Product use

Products must be used only for their intended purpose and in accordance with any instructions provided.

Stop using a product if it becomes damaged or appears unsafe.

Information provided through the CALIYI online store is general information and is not medical, dermatological or other professional advice.

Individual results and experiences may vary.

Reviews and customer content

Where you submit a review, photograph, video, testimonial, comment or other content, you confirm that:

• You created the content or have permission to submit it.
• The content reflects your genuine experience.
• The content is not false or misleading.
• The content does not infringe another person’s rights.
• The content is not unlawful, threatening, defamatory or offensive.

You grant CALIYI a non-exclusive, worldwide, royalty-free licence to reproduce, display, edit and use submitted content in connection with our online store, social media, advertising and customer communications.

You may contact us if you wish to request removal of content you have submitted.

We may remove or decline content that breaches these terms.

Intellectual property

Unless otherwise stated, all content displayed through the CALIYI online store belongs to CALIYI or its licensors.

This includes:

• Business names.
• Logos.
• Branding.
• Product names.
• Photographs.
• Videos.
• Graphics.
• Product descriptions.
• Written content.
• Website design.

You may access this content for personal shopping purposes.

You may not reproduce, distribute, modify, sell or commercially exploit our content without prior written permission.

Third-party services

Our online store may contain links, applications or services operated by third parties.

Third-party services may be governed by their own terms and privacy policies.

CALIYI is not responsible for third-party content, services or security except to the extent required by law.

Errors and omissions

Where an error materially affects an order already placed, we may contact you to confirm whether you wish to proceed with corrected information or receive a refund.

The terms applying to an order will generally be those displayed when the order was placed, unless a change is required by law.

Governing law

These Terms of Service are governed by the laws of Queensland, Australia.

You and CALIYI submit to the courts and tribunals having jurisdiction in Queensland, subject to any rights available under applicable consumer law.
